they can say that while you were below the legal limit, however you were still impared...i dont know the details of B's expierence but they could have told him that he was impared to some extent...

Yeah, it's kinda BS. By law, the limit is .08. But by law, the officer also has discretion on what he considers impaired. So even if B blows a .07, but the officer deems he failed the field sobriety and cannot operate a vehicle safely, they can charge him with it. This same thing happened to my friend at work. He also blew a .07 and got fucked.

I'm not 100% sure I'll be there at the meet this Thursday. It all depends on how much I have to do at work this week. If I show, I'll be just a tad late.

Yeah, the officer decided to fuck me. Gave me about 5 field sobriety tests. It was on an unlevel part of the road (rain gutter almost) and on a freshly sprained ankle and a knee with a crushed miniscus, both of which I told him about. It was two weeks after my 21st B-Day too! Guess they needed money for the new convention center thay were building....
